Article 2 - Purpose
The purpose of these GTC is to define the rights and obligations of the parties (SublimeResto and the users) regarding the use of the SublimeResto service and the purchase of credits to generate professional quality photos of dishes.
Article 3 - Access and registration to the service
Access and registration to the SublimeResto service is free and open to persons of legal age and capacity. Users must create an account by providing a valid email address. A login link is sent to this email address. Users are responsible for the confidentiality and security of their email address and the use of their account.
Article 4 - Purchase of credits
Users can purchase credits in two ways: by the unit, by pack (e.g. 5, 10, 20, 50 credits) or by subscription (a number of credits per month with a monthly payment). Prices are indicated on the SublimeResto website and are subject to change at any time. Payments are made online via secure payment solutions. All payments are final and non-refundable, unless otherwise stated in these T&Cs or required by applicable law.
Article 5 - Use of funds
Credits allow users to upload photos of dishes to the SublimeResto service and generate enhanced photos. One credit is equivalent to one photo sent on the service. Once this photo is sent, it is necessary to describe it and choose the parameters to generate the result. It is then possible to request 3 generations in autonomy via the application. It is possible to contact the service by email to request more generations if the first generations are not satisfactory.
Credits remain valid on the user's account for at least one month after purchase, but their validity can be extended without guarantee. Credits are non-transferable and cannot be exchanged for cash.
The use of SublimeResto is strictly reserved for the visual enhancement of dishes, foods and drinks. Any other use is prohibited and will result in an immediate suspension of the user's account with no refund of remaining credits. Users are required to respect these terms of use to ensure a quality service to the entire SublimeResto community.
Article 6 - Intellectual Property
SublimeResto owns all intellectual property rights to the service, technologies and associated content. Users are granted a limited, non-exclusive, non-transferable and revocable license to use the photos generated for commercial and promotional purposes.
Article 7 - Responsibilities and guarantees
SublimeResto makes every reasonable effort to ensure the quality of the photos generated, but does not guarantee that the results will always be satisfactory or error-free. Users use the service at their own risk and under their sole responsibility. SublimeResto will not be held responsible for any direct or indirect damages resulting from the use of the service or the inability to use the service.
Article 8 - Protection of personal data
SublimeResto is committed to processing users' personal data in accordance with the General Data Protection Regulation (GDPR) and French data protection legislation. Users have the right to access, rectify and delete their personal data, as well as the right to object to or limit the processing of their data. Article 9 - Modification and termination of the service
SublimeResto reserves the right to modify, suspend or terminate the service at any time and without notice, for technical, regulatory or other reasons. In the event of termination of the service by SublimeResto, users will be notified by email and credits purchased within the last 30 days and not used will be refunded on a pro-rata basis.
Article 10 - Applicable law and competent jurisdiction
The present GTU/CGV are governed by French law. In the event of a dispute between SublimeResto and a user concerning the interpretation, execution or termination of these GTC/CS, the parties will endeavor to resolve the dispute amicably. If no amicable solution can be found, the dispute will be submitted to the competent courts of Lyon, France.
